POOL FENCING

(A) Fence enclosures for swimming pools shall comply with Municipal Swimming Pool Fence By-laws where applicable.

(B) In areas where no Swimming Pool Fence By-laws apply, the following guidelines are recommended:

1. These guidelines apply to outdoor swimming pools whether above or in ground and which have a maximum depth of water greater than thirty (30”)inches.

2. The owner shall erect and maintain around the pool, an enclosure which extends from the ground for a height of not less than five (5’) feet.

3. Gates shall be constructed of material of equivalent strength as the fence and shall be of at least the same height as the fence enclosure.

4. Gates shall be supported by substantial hinges and be equipped with self-closing, self-latching devices placed at the top and on the inside of the gate.

5. Enclosures may have a wall of buildings as part of the fence, provided the five (5’) foot height requirement is maintained, and any doors to the pool area shall be kept locked at all times when the pool is not in use.
